Innovative Legal Services (ILS) successfully secured a complete defense victory in a high-stakes JAMS arbitration involving a global cryptocurrency and financial technology platform. Led by Managing Partner Richard Liu, Esq. with Senior Counsel Xue (Yuki) Chang, Esq. and Associate Zihan (Ellen) Zheng, Esq. the ILS team defeated all six claims brought by a former executive under the Massachusetts Wage Act and related common law theories, eliminating more than $4 million in potential liability for the company and two executive defendants.
Case Background
The arbitration arose out of a broad commercial dispute between the former executive and the company involving compensation, bonuses, intellectual property ownership, and the use of technical work product. After departing the company, the executive initiated arbitration against both the company and two individual executives, asserting multiple claims under the Massachusetts Wage Act, breach of contract theories, and related causes of action, while seeking damages exceeding $4 million.
Beyond the financial exposure, the claims also created direct legal pressure on the individual executives. According to the ILS team, the case appeared strategically designed not only to pursue damages, but also to place operational and reputational pressure on company leadership through personal claims against management.
The Challenge: A Carefully Constructed Narrative
According to the legal team, one of the most difficult aspects of the case was the plaintiff’s highly calculated approach to documentation and narrative-building. The former executive portrayed himself as a loyal, high-performing employee who had sacrificed for the company only to be unfairly pushed aside — a narrative that, on its face, carried significant emotional appeal.
The plaintiff also created an extensive paper trail that appeared carefully curated to support his version of events. From signed documents to email communications, nearly every step seemed strategically positioned to reinforce a future legal claim. This created an especially difficult dynamic for the defense because many of the written records initially appeared favorable to the plaintiff.
As Senior Counsel Yuki Chang explained during internal case discussions, employment disputes already tend to place employers in a reactive position. In this matter, the legal team believed the plaintiff had effectively “designed the dispute before filing it.”
Richard Liu noted that the case ultimately turned on an extraordinary level of factual precision and detail analysis:
“The key was finding the details hidden inside the details. The entire outcome depended on reconstructing the full picture from small inconsistencies that initially seemed insignificant.”
Reconstructing the Timeline and Breaking the Narrative
Rather than responding emotionally to the allegations, the ILS team focused on rebuilding the underlying timeline piece by piece through objective evidence. Using internal communications, email timestamps, system records, and court filings, the team gradually identified inconsistencies in the plaintiff’s narrative and uncovered signs that portions of the record may have been intentionally created to support future litigation claims.
During the course of the arbitration, the team identified what Richard Liu described as two major “pressure points” in the case:

As the full chronology came together, the defense team concluded that several events occurred in ways that appeared unusually coordinated or strategically timed.

By systematically rebuilding the factual record, the ILS team was able to expose contradictions within the plaintiff’s account and dismantle the credibility of the broader “victim narrative” presented throughout the arbitration. Ultimately, the arbitration panel rejected all six claims in their entirety.
Complete Defense Victory
The arbitration panel fully adopted the defense’s position and entered an award of zero liability against both the company and the individual executive defendants. All six claims were dismissed, allowing the client to avoid more than $4 million in claimed damages.
The result reflects ILS’s broader approach to high-risk commercial and employment disputes: legal strategy is not merely about responding to litigation, but about helping companies manage operational, reputational, and business risk in parallel.
The case also underscored several practical lessons for employers managing executive relationships and departure-related disputes. Richard Liu emphasized the importance of maintaining strong documentation practices throughout the employment relationship:
“If I had to summarize the biggest takeaway for employers, it would be this: companies must learn how to properly document.”
Yuki Chang added that employers should exercise particular care when drafting offer letters, bonus structures, and other formal employment documents, ideally with legal review before implementation. Zihan Zheng further noted that companies should pay close attention to communication strategy and overall situation management during executive departures, observing that:
“In many cases, the company is not simply managing one employee dispute — it is managing the broader situation surrounding the dispute.”
In high-risk executive disputes, where employment claims are sometimes used as leverage against broader business operations, ILS continues to help clients stabilize the situation, focus on evidence, and defend their businesses through disciplined legal strategy and factual precision.
