ILS Helps Leading Consumer Electronics Company Resolve FCC Investigation with Zero Penalty
The deadline had passed. A second FCC letter had arrived. And the risk of enforcement was escalating.
ILS recently represented a California-based consumer electronics company in an investigation by the Federal Communications Commission (FCC). By the time ILS stepped in, the company had already missed its initial response deadline and faced the prospect of further enforcement action and significant monetary penalties. Following an intensive response effort, the investigation concluded without a monetary penalty against the client.
The matter was led by ILS Managing Partner Richard Liu, Esq., with Ellen Zheng, Esq. assisting on the response and regulatory strategy.

Case Background: The Pressure Was Already Building
The client is a California-based consumer electronics company with products distributed nationwide.
In May 2026, the FCC’s Enforcement Bureau issued a formal inquiry concerning product compliance and requested information and supporting documents within a specified timeframe. The company did not complete its response by the original deadline. Then came the second letter.
The FCC warned that failing to respond on time could itself constitute a violation and lead to additional enforcement action. The agency also cited prior enforcement matters involving proposed penalties of up to $300,000 for similar failures to provide timely or complete responses. At that point, the stakes had changed.
This was no longer simply a question about product compliance. The company was now facing a federal investigation with the potential for substantial penalties and escalating regulatory exposure.
From Playing Defense to Taking Back Control
ILS legal team was brought in after the matter had already escalated.
With the clock running, Richard Liu and Ellen Zheng worked closely with the company’s management team to reconstruct the history of the investigation, identify the key factual and regulatory issues, and organize the company’s response.
Speed mattered. But getting it right mattered more. Under a tight regulatory timeline, the ILS team prepared and submitted the company’s formal response, together with the required supporting materials and a sworn declaration from company leadership.
The strategy was not simply to get something out the door. It was to give the FCC a complete, credible response while bringing an increasingly difficult situation back under control.
And that is exactly what happened. The company received no monetary penalty in connection with the investigation. The regulatory risk was successfully addressed, and the client was able to move forward with its U.S. operations.
A Government Investigation Is Never Just a Letter
The outcome is significant. But the lesson for companies operating in the United States is bigger than one FCC matter.
When a regulator comes knocking, product compliance rarely exists in isolation. Supply chains, internal records, certifications, management decisions, and the company’s communications with the government can quickly become part of the same problem.
And once an investigation begins, small gaps can become expensive ones.
For fast-growing companies in particular, compliance has to keep pace with the business. A missed deadline or incomplete record may seem manageable in ordinary operations. Under federal scrutiny, it can take on an entirely different significance.
That is why companies facing a government inquiry need to answer three questions quickly: What happened? Where is the risk? What do we do next?
When the stakes are high, the goal is not simply to respond. It is to understand the exposure, regain control, and protect the business.
